U.K. Supreme Court cites articles by Andreas Lowenfeld
A ruling issued by the Supreme Court of the United Kingdom on June 30 cited a pair of articles by , Herbert and Rose Rubin Professor of International Law Emeritus. In Smith v. Secretary of State for Defence, the court considered the applicability of the European Convention on Human Rights to a British soldier’s death from heatstroke in Iraq. (The Supreme Court has replaced the House of Lords as the U.K.’s highest tribunal.) As part of a discussion of extraterritorial application of law, Lord Collins of Mapesbury referenced two articles by Lowenfeld. Both were from a series titled “U.S. Law Enforcement Abroad: The Constitution and International Law” that appeared in the American Journal of International Law in 1989 and 1990.
