California has passed a new law that calls for sectoral bargaining among fast food workers and employers. The approach of multiple employers negotiating for industry-wide terms with labor is more prevalent in Europe and provides a means to secure labor gains across an industry. What are the benefits and challenges of such an approach for the parties involved? Is Taft-Hartley preemption likely to be a problem? Does this approach introduce government imposition of terms through the guise of collective bargaining? Is that necessarily a bad thing for low-wage labor markets?
